Terms of Service

These Terms of Service ("Terms") govern your access to and use of Resume Nexus ("the Service"), operated by Guardian Nexus LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Resume Nexus is a software-as-a-service (SaaS) tool that uses artificial intelligence to compare resumes against job descriptions and generate screening assessments. The Service is intended to assist human recruiters and hiring managers — it does not make hiring decisions.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By creating an account, you represent that you meet these requirements.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and current information when creating your account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation, including employment discrimination laws.
  • Upload content that is illegal, defamatory, or infringes on third-party rights.
  • Attempt to reverse engineer, decompile, or extract the source code of the Service.
  • Use the Service to make automated hiring or rejection decisions without human review.
  • Share your account credentials or allow unauthorized third parties to access your account.
  • Attempt to circumvent rate limits, security measures, or access controls.

5. AI-Generated Results Disclaimer

The screening scores, recommendations, and analysis provided by the Service are AI-generated and may contain errors, inaccuracies, or biases.

  • Results are intended as a screening aid, not a final determination of candidate suitability.
  • Scores may vary between runs due to the non-deterministic nature of AI models.
  • Results from different AI models or providers should not be directly compared.
  • You are solely responsible for verifying all results against actual resume content before making any employment decisions.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated assessment.

6. Your Data

  • You retain ownership of all resumes, job descriptions, and other content you upload to the Service.
  • We process your uploaded content solely to provide the screening service and do not sell or share it with third parties for their own purposes.
  • AI analysis is performed using third-party AI providers (e.g., OpenAI, Anthropic). Your content may be sent to these providers for processing, subject to their respective terms and privacy policies.
  • You may delete your data at any time through the Settings page. Deletion is permanent and cannot be undone.

7. Data Retention

You may configure your preferred data retention period in Settings. We will automatically delete screening results and associated documents according to your retention preferences. If no preference is set, data is retained until you manually delete it or close your account.

8. Third-Party AI Providers

The Service relies on third-party AI providers for analysis. You may choose your preferred provider in Settings and supply your own API key. When using your own API key:

  • You are subject to the terms and pricing of your chosen AI provider.
  • API keys are encrypted at rest and never stored in plaintext.
  • We are not responsible for charges incurred on your AI provider account.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.

10. Limitation of Liability

To the maximum extent permitted by law, Guardian Nexus LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages resulting from hiring decisions informed by AI-generated screening results.

11. Indemnification

You agree to indemnify and hold harmless Guardian Nexus LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.

13. Termination

You may close your account at any time through the Settings page. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your data according to our data retention policies.

14. Governing Law

These Terms are governed by the laws of the State of Virginia, United States, without regard to conflict of law principles.
